Terms of Service

1. Acceptance of Terms

By accessing or using Why My Site Sucks ("WMSS", "the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

WMSS is a web audit platform that analyzes websites for performance, security, SEO, accessibility, and best practices. The Service offers both free frontend audits and paid plans with additional features including backend analysis via a read-only PHP probe.

3. User Accounts

Account creation is handled via magic link email authentication. You are responsible for maintaining the security of the email address associated with your account. You must provide accurate information and promptly update it if it changes.

4. Acceptable Use

You agree to use the Service only for lawful purposes. You may only analyze websites that you own or have explicit authorization to audit. You must not attempt to overload, disrupt, or exploit the Service. Automated mass-scanning without prior written consent is prohibited.

5. Probe Installation

The backend analysis probe is a read-only PHP file installed on your server. By installing the probe, you confirm that you have the authority to do so. The probe only reads server configuration data and never modifies files, databases, or settings. You may remove the probe at any time.

6. Payments & Subscriptions

Paid plans are billed monthly or annually via Stripe. Prices are in USD. You may upgrade, downgrade, or cancel your subscription at any time. Downgrades take effect at the end of the current billing period. Refunds are handled on a case-by-case basis.

7. Intellectual Property

All content, branding, and technology of the Service are the property of WMSS. Audit reports generated for your websites are yours to use, share, and distribute. White-label reports may be rebranded under Agency and Enterprise plans as permitted by your subscription.

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind. WMSS is not responsible for decisions made based on audit results. Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

9. Termination

We may suspend or terminate your access to the Service if you violate these terms. You may delete your account at any time. Upon termination, your data will be deleted within 30 days, except as required by law.

10. Changes to Terms

We may update these terms from time to time. Material changes will be notified via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated terms.
